Gardner Construction, LLC (“Gardner Construction,” “we,” “us,” or “our”) is a Texas-based commercial and residential builder headquartered at 15950 SH 205, Terrell, TX 75160. We do not intentionally collect drawings/spec files, nor do we solicit information from children. (See § 11.)

Directly from you – when you submit a website form, upload a résumé, call us, or meet us in person.
Automatically – via cookies and similar technologies described in § 5.
Lead-generation partners – when you complete a LinkedIn “Request a Quote” or similar form.
4. Why we use your information
- Respond to inquiries and provide project estimates
- Evaluate and process job applications
- Operate, secure, and improve our website and IT systems
- Perform aggregate analytics about site traffic and marketing effectiveness
- Comply with legal obligations and defend our rights
We do not send promotional newsletters or sell/rent your data.

As of January 1, 2025, Section 541.055(e) of the Texas Data Privacy and Security Act (“TDPSA”) requires us to honor universal opt-out signals—for example, a Global Privacy Control header—when used in a compatible browser.
6. Legal grounds for processing
Although TDPSA does not require a “legal basis” framework, we generally rely on:
- Legal obligations – record-keeping, employment law, or court orders
- Contractual necessity – to answer your requests or perform pre-contract steps
- Legitimate interests – website analytics, security, business administration
- Consent – where you voluntarily supply information (e.g., newsletter signup)
7. Sharing & disclosure
We share personal data only as needed with:
- Service providers – 407 Marketing (web services/CRM), GoDaddy (hosting/DNS, ISO-certified), Microsoft (e-mail/Office)
- Affiliates/partners – Gardner-Adams Homes and future development partners, to coordinate joint projects
- Regulators or law enforcement – if required to comply with the law or protect our rights
We do not sell personal data, and we do not transfer it outside the U.S. except to U.S.-based cloud hosting providers.

10. Your privacy rights
Under the Texas Data Privacy and Security Act, all U.S. residents can:
- Know whether we process your personal data
- Access a portable copy of your data
- Correct inaccuracies
- Delete personal data
- Opt out of (a) targeted advertising, (b) sale of personal data, and (c) certain profiling decisions

We will respond within 45 days (extension possible to 90 days) and will not discriminate against you for exercising your rights. texasattorneygeneral.gov
How to exercise your rights – Submit a request via our Privacy Webform. If we decline, you may appeal through the same form; unresolved disputes may be referred to the Texas Attorney General.
11. Children’s privacy
Our site is directed to businesses and adults. We do not knowingly collect personal information from children under 13. If we learn that we have done so, we will delete the data in accordance with the Children’s Online Privacy Protection Act (COPPA).
12. Changes to this policy
We may update this Privacy Policy from time to time. The revised version will be posted on this page with the new “Effective Date.” We do not provide separate notice of changes. The Web Services Contractor (407 Marketing) approves all revisions.
